BATA Policy Statement – Disadvantaged Business Enterprise – Tier II Recipient

The Bay Area Transportation Authority (BATA), as a Tier II recipient,  will ensure nondiscrimination in the award and administration of Department of Transportation-assisted contracts in the Department’s highway, transit, and airport financial assistance programs.

 

BATA will create a level playing field on which Disadvantaged Business Enterprises (DBEs) can compete fairly for Department of Transportation-assisted contracts.

 

BATA will ensure that the Department of Transportation’s DBE program is narrowly tailored in accordance with applicable law and will ensure that firms that fully meet this part’s eligibility standards are permitted to participate as DBEs.

 

BATA will make an effort to help remove barriers to the participation of DBEs in Department of Transportation-assisted contracts and promote the use of DBEs in all types of federally assisted contracts and procurement activities conducted by BATA or its recipients.

 

BATA will assist in the development of firms that can compete successfully in the marketplace outside of the DBE program and provide appropriate flexibility to recipients of Federal financial assistance in establishing and providing opportunities for DBEs.
